Defense summation of expert testimony in closings of case claiming defective seatbelt design

The trial: Perry v. Kia Motors

 

The attorney: James Feeney

 

Case summary: Kamiya Perry suffered a catastrophic brain injury in a crash involving a 2015 Kia Forte. Her attorneys contend the lack of a seatbelt pretensioner caused her head to strike the vehicle's roof when it rolled over.   

 

Synopsis: Feeney weaves attacks on the conclusions of the plaintiff's experts with testimony and conclusions from  Dr. Daniel Toomey, a design engineer, who concluded a pretensioner would not have prevented Perry's injuries. Among Toomey's conclusions, Feeney reiterates: the angle of impact, based on testing, shows a pretensioner would not have safeguarded Perry in the crash. 

 

The verdict: Defense verdict.
